Terms of Service

Agreement

These Terms of Service (“Terms”) apply to the MileWiz app for iPhone and iPad, the MileWiz website and MileWiz support (together, the “Service”), provided by SILVERWIZ LLC (“we”, “us”). The app is licensed to you under Apple’s Licensed Application End User License Agreement together with these Terms. By using the Service you agree to these Terms. If you do not agree, please don’t use the Service.

Your mileage records

MileWiz is a tool to help you keep a record of your driving. It is not tax, legal or accounting advice. Automatic detection depends on your device, its settings and conditions such as GPS reception, so MileWiz can miss a trip or record it inaccurately. Mileage rates in the app are provided for convenience and may not apply to you or may change.

You are responsible for reviewing your trips, categories, rates and reports, and for the accuracy of any claim, return or reimbursement request you make with them. Ask a qualified professional if you are unsure what applies to you.

Safe use

MileWiz records trips in the background so you don’t have to touch your phone while driving. Never use the app in a way that distracts you from the road, and always follow traffic laws.

Free Driving Plan and subscriptions

MileWiz is free to download. The Free Driving Plan automatically tracks up to 20 trips each calendar month. Trips recorded beyond the free limit are hidden until you subscribe and kept until the end of that month; if you do not have an active subscription, MileWiz removes them during the next month, once the App Store confirms you have none. Adding trips by hand also pauses once the limit is reached.

The Unlimited Driving Plan is an auto-renewing subscription sold through Apple’s App Store, billed monthly or yearly at the price shown before purchase. Payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period; your account is charged for renewal within the 24 hours before the period ends. You can manage or cancel your subscription in your Apple Account settings. Refunds are handled by Apple under its policies.

We may change subscription prices. Apple notifies you of price changes as its rules require, and changes take effect no earlier than your next billing period. We may offer free trials or promotional prices from time to time under the terms shown with the offer.

Your data

Your trips and other records belong to you. They are stored on your device and, if automatic backups are on, in your own iCloud account, as described in our Privacy Policy. You are responsible for keeping your device secure and for keeping copies of records you need, for example by exporting reports. iCloud is provided by Apple, and backups depend on your iCloud account, storage and settings.

Acceptable use

Don’t use the Service to break the law, to track another person without their knowledge or consent, or to interfere with the Service or other people’s use of it. Don’t copy, modify, reverse engineer or resell the app except as the law allows.

Third-party services

The Service relies on services provided by others, including Apple’s App Store, iCloud and map services, and the Reso support chat. Their availability is not under our control, and their own terms and privacy policies apply. Links to other websites are provided for convenience; we are not responsible for their content.

Intellectual property

The Service, including its design, text, graphics and software, is owned by SILVERWIZ LLC and its licensors and protected by copyright, trademark and other laws. MileWiz and MoneyWiz are trademarks of SILVERWIZ LLC. You may not use them without our written permission.

If you believe content in the Service infringes your copyright, email hello@milewiz.com with the subject “Copyright Infringement”, a description of the work, where it appears, your contact details, a statement of good-faith belief, and a statement under penalty of perjury that your notice is accurate and that you are the owner or authorized to act for the owner.

Changes and availability

We work to keep MileWiz running and improving, and we may add, change or remove features. We may suspend or end access for anyone who seriously or repeatedly breaks these Terms.

Disclaimer

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, that every trip will be detected or recorded accurately, or that the results will meet your requirements.

Limitation of liability

To the fullest extent permitted by law, SILVERWIZ LLC and its directors, employees, partners and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, tax benefits, reimbursements, use or goodwill, arising from your use of or inability to use the Service, from records created with it, or from any third-party service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid for MileWiz in the twelve months before the claim or US$50.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for some damages, so some of the limits above may not apply to you. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

Indemnification

You agree to indemnify SILVERWIZ LLC against claims, losses and costs, including reasonable legal fees, arising from your misuse of the Service or your breach of these Terms.

Governing law

These Terms are governed by the laws of California, United States, without regard to its conflict of law rules. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, Apple’s Licensed Application End User License Agreement and the Privacy Policy are the entire agreement between us about the Service. If these Terms conflict with Apple’s agreement about your license to use the app, Apple’s agreement applies.

Changes to these Terms

We may update these Terms. If a change is material, we will give at least 30 days’ notice on this page before it takes effect. If you keep using the Service after the change takes effect, you accept the updated Terms.
